PORTLAND, Ore. Thirteen Muslim Americans challenging the U.S. government's secretive "no-fly" list won a partial victory in federal court when a judge found they "have a constitutionally protected liberty interest" in traveling internationally by air.
But U.S. District Judge Anna Brown has yet to decide whether the government violated their constitutional rights to due process under a policy that excludes individuals from commercial air travel if they are suspected of having ties to terrorism.
They complain they only learned of their no-fly status after buying airline tickets, arriving at airports and being refused permission to board a plane. The government has refused to officially acknowledge travel packages at a discount that they are on its list.
The only recourse an individual has for clearing one's name, they argue, is an essentially dead-end process by which the individual fills out a form and receives back a letter with no explanation or even a confirmation travel packages at a discount of the no-fly travel packages at a discount status.
During a hearing in June, Brown questioned travel packages at a discount if the government's procedure of directly appealing a no-fly status to an appellate court was feasible. Appellate judges are limited travel packages at a discount to reviewing a record established through lower-court proceedings.
"For the first time, a federal court has recognized that when the government bans Americans from flying and smears them as suspected terrorists, it deprives them of constitutionally protected liberties, and they must have a fair process to clear their names," ACLU attorney Nusrat Choudhury said in a statement.
The no-fly list, established in 2003 in the aftermath of the Sept. 11, 2001, attacks, bars those on it from flying within the United States or to and from the country. It is shared with foreign governments.
As of last year, the list included travel packages at a discount some 20,000 people deemed by the FBI as having, or reasonably suspected travel packages at a discount of having, ties to terrorism, an agency spokesman said at the time. About 500 of them were U.S. citizens.
Among the 13 plaintiffs challenging the policy are four U.S. military veterans, one a former member of the Air Force who has been separated from his wife since 2010 while she was stuck in Ireland with visa troubles.
Another plaintiff, Aalah Ali Ahmed, says he could not travel to Yemen when his brother died and has been unable to visit his extended family or manage property he owns in Yemen. Your comment shows you are clueless on this issue. It's not just Muslims who are affected by this "list". And, you have NO proof of the 40 percent you so glibly toss out. 9 votes #1.1 - Thu Aug 29, 2013 10:52 PM EDT SeptikSkeptik
As long as those 13 Muslims don't fly on the same airline, on the same day and start hollering Allah Akbar; I am cool with that....otherwise there will be a lot of passengers crapping on their pants when the flight takes off including the pilot....and it's never a good sign when a pilot craps all over the cockpit 2 votes #1.4 - Fri Aug 30, 2013 12:33 AM EDT Marky-239878
Now that's a stupid comment... have you ever heard of any attacks on Norway? Luxembourg? San Marino? Slovenia? Latvia? should I go on while your rush to get a map to know what the heck I'm talking about... yes, there are other countries besides US, Canada and Mexico. :-) 2 votes #1.5 - Fri Aug 30, 2013 3:43 AM EDT Blitzkrieg39
travel packages at a discount Not being able to fly can drastically affect your employment opportunities, among other things. This is a severe punishment, and these individuals may well deserve such punishment, but if so they should be given a fair trial first. Nobody should be punished without a fair trial. 5 votes #2 - Thu Aug 29, 2013 10:34 PM EDT Ippster
So, you are saying, "wait until they kill a bunch of people before saying they can not fly, even though we suspect they are associated with terrorists?" I think the families of those killed by terrorists would differ with you entirely. 5 votes #2.1 - Thu Aug 29, 2013 11:36 PM EDT Ourdoc
The entire "no fly list" is an unconstitutional deprivation travel packages at a discount of basic rights. When placed on the list, you are not informed, you can't confront your accuser, you are unable to see the evidence against you, you are simply tried, convicted and sentenced by some bureaucrat based solely on your name. When you can't get onto an airplane, you are not told why, the "list" supposedly does not exist, yet it is used to prevent thousands from flying every day. Even in the absolute worst nightmare scenarios of Catch 22 or 1984 the bureaucrats and Big Brother at least informed you that you couldn't do what you wanted to do.
In February 2006, U.S. Senator Ted Stevens (R-AK) stated in a committee travel packages at a discount hearing that his wife Catherine had been subjected to questioning travel packages at a discount at an airport as to whether she was Cat Stevens travel packages at a discount due to the similarity of their names
In October 2008, the Washington Post reported that Maryland State Police classified 53 nonviolent travel packages at a discount political activists as terrorists, and entered their names and personal information into state and federal databases, with labels indicating that they were terror suspects.
travel packages at a discount For a couple years after 9/11 my name too was on the list (my real name). I'm a brown haired, blue eyes, regular travel packages at a discount named American who had never broken any laws. I was also active duty in US Navy, Military ID, Military Orders, Military baggage, etc.... I was told to stand and wait to the side of the check-in counter. After 10 minutes of waiting (including the unwelcome stares travel packages at a discount of the people behind me) the airline person would come back and say I was free to go. After a couple years, travel packages at a discount "my name" was removed from the list. I would like to think/hope that the current no-fly-list is better managed than what it was after 9/11. 2 votes #3.1 - Fri Aug 30, 2013 12:20 AM EDT golliegeewillikers22
Pretty soon they will find something in the constitution that allows them to blow up what ever they want and murder as many American's as possible travel packages at a discount as the illegal aliens from the south take over the entire country uncontested of course because Christ knows this country isn't worth saving, not with Obama at the helm.
Welcome to the US. Now you know how hard it is to even start a small business and all of the government hoops you have to go through. travel packages at a discount One government agency tells you one thing and the next tells you something completely different. You can never talk to a real person and when you do, they just send you someplace else and give you more paperwork to fill out. We feel your pain. #5 - Thu Aug 29, 2013 10:45 PM EDT Sexy Jesus
Awesome that you have the name 'Letusreason' and then use about the most general type of statement ever while using little reason...if you really think all Muslims only accept Islamic law as written in the Quran, you're insane. Do you also think all Christians only accept Biblical law? Or is your narrow vision of people travel packages at a discount only towards one religion? Do you actually know any Muslims? If so, do them all only follow Islamic law? (I'd be very surprised if your answer could possibly be Yes to those last 2) 1 vote #9.1 - Fri Aug 30, 2013 10:15 AM EDT Letusreason
Christians haven't been blowing folks up recently. Experience shows that Muslims, on the surface, comply with local laws until they're instructed through their religious leaders do do something else.
Careful, be cautious and don't allow PC and manipulative Muslims to change our laws. If they don't like our ways and our laws they can return to what ever Muslim country they wish. They are not happy here.

One of the oft tossed out responses to travelers' complaints regarding the TSA and the government's security initiatives which restrict commercial airline passengers is that no one has a "right" to fly and that if you chose to do so then you must tolerate whatever the government then chooses to subject you to, all in the name of safety and national security.
The judge's partial ruling in this case is a victory for all Americans because she's essentially stating that the United States Constitution protects the "liberty travel packages at a discount interest" that we all have in traveling by air although her ruling is specific to flying internationally .
It is apparently more important to some "who" the plaintiffs are instead of the fact that they stood up and won a battle that benefits even those who have ill-will towards them as demonstrated here on this board.
In my opinion congratulations are in order to the ACLU, the plaintiffs and to Judge Brown who had the insight to understand that the government's appeal process is just a wild goose case leading to a dead end
During travel packages at a discount a hearing in June, Brown questioned if the government's procedure of directly appealing a no-fly status to an appellate court was feasible. Appellate judges are limited to reviewing a record established through lower-court proceedings.
Not Worth Much---Which, what war, Nancy Reagon and William Bennett declared victory travel packages at a discount in the war on drugs in 1988. But I was never given back my 4th admendment. George W. declared victory somewhere on an aircraft carrier. Dim constitutionalists who can quote the 2nd admendment seem to forget that only CONGRESS can declare
