Rabbi Binyomin Ginsberg (R) talks to reporters about his case, in which he sued Northwest Airlines for breach of contract after the airline said he had abused their frequent flyer program, following arguments before the U.S. Supreme Court in Washington December 3, 2013. Reuters
kosher restaurants los angeles Rabbi S. Binyomin Ginsberg said Northwest, since absorbed by Delta Air Lines Inc., did not act in good faith when it cut him off. The airline says the federal deregulation of the airline industry in 1978 rules out most lawsuits like the one filed by Ginsberg.
kosher restaurants los angeles It sounds to me like I go in to, you know, get a ticket, my reasonable expectation is they re not going to charge me what they re going to charge, you know. I mean, it s unbelievable, Breyer said. Under Ginsberg s view of the case, Breyer said he could sue over the prices.
Ginsberg said in court papers that he and his wife flew almost exclusively on Northwest, logging roughly 75 flights a year to travel across the U.S. and abroad to give lectures and take part in conferences on education and administration.
Northwest says Ginsberg complained 24 times in a 7-month period, including nine instances of luggage that turned up late on airport baggage carousels. Northwest said that before it took action, kosher restaurants los angeles it awarded kosher restaurants los angeles Ginsberg $1,925 in travel credit vouchers, 78,500 bonus miles, a voucher for his son and $491 in cash reimbursements.
A federal trial judge cited earlier Supreme kosher restaurants los angeles Court cases involving claims against frequent flyer programs in dismissing Ginsberg s lawsuit, including his claim that Northwest did not live up to the terms of the contract. The judge said the contract gives the airlines the right to kick someone out of the mileage program at its sole judgment.
But the 9th U.S. Circuit kosher restaurants los angeles Court of Appeals in San Francisco said part of the suit could go forward involving kosher restaurants los angeles whether Ginsberg and others can sue under state laws that require parties to a contract to act in good faith.
If the airline could easily avoid living up to its end of the bargain in the mileage kosher restaurants los angeles program, Kagan said, I don t think that I d be spending all this time in the air on your planes. You know, I d find another company that actually gave me the free ticket.
So if some airline really were crazy enough to systematically turn on its most lucrative kosher restaurants los angeles and loyal customers, surely, the market would solve that. And, of course, if a bunch of airlines did it, the Department of Transportation stands ready to police that, he said.
Several justices questioned whether it is important to the case that many people earn and spend miles on items other than airline tickets. Do we have to worry about that in this case? Justice Samuel Alito asked.
Adina Rosenbaum, Ginsberg kosher restaurants los angeles s lawyer, told the court that the growth of mileage programs to encompass more than airline tickets is another reason to rule that Ginsberg s lawsuit is not blocked by the deregulation law.
"Northwest says Ginsberg complained kosher restaurants los angeles 24 times in a 7-month period, including nine instances of luggage that turned up late on airport baggage carousels." To me that sounds like a fair complaint. Not sure what Northwest calls complaining kosher restaurants los angeles too much. i would sooner cut off all the guys that do shtick by booking airlines then canceling last minute just to cash in on points.
kosher restaurants los angeles Some people comment without knowing the details. He was one person that complained when things went wrong. At no time did they note that any complaints were unfounded. It is a bit absurd that an airline can cancel the miles and steal what you earned as your part of the bargain that their program offers. kosher restaurants los angeles I never heard of any way to earn miles by booking and cancelling, by the way.

I think he's going to lose. The frequent flyer program is a perk. Otherwise, the airline lived up to its end of the bargain. He bought a coach ticket and he got a coach seat, and he was delivered to his destination...in coach. That the airline decides to toss you a bone because you have flown so many miles with it, and give you a nicer seat (or a free one) is up to the airline.
I am shocked at some of the comments here, and I propose a hypothesis that might be subjected to psychological study. The anonymity permitted by blogs brings out the deep seated rage and anger by posters that trigger them to make disparaging, accusatory, and degrading comments about people they do not know and/or regarding subjects that are outside of their domain of expertise. While this may be a democratic privilege, it is also a rather disgusting character trait, and the anonymity allows those with such character to protect themselves while trying to destroy others. Any researchers out there willing to give this a shot?
