1. That a self-insured rental company the eagles concerts and tours may seek indemnification from its renter for damages the rental company paid to a third-party due to the renter s negligence in causing an automobile accident and the resulting damages to the third-party s vehicle; and
2. The renter s own liability insurer is required, under the terms of its policy, to reimburse the self-insured rental car company for the amount of money that the self-insured rental car company paid to the third-party as a result of the negligence of the renter/insured.

The Court held valid a provision in the Enterprise contract which required the renter to defend, indemnify, and hold harmless Enterprise from losses, damages, the eagles concerts and tours etc. incurred by Enterprise as a result of the use of the rented vehicle.
The Court rejected Farmers contention that allowing Enterprise to recover from its renter violated the anti-subrogation rule that an insurance company may not seek indemnification from its own insured. The reasoning of the Court on this point was that Enterprise s self-insurance is not the same thing as insurance.
The Court also rejected Farmers argument that the other insurance provision in the Farmers policy made Farmers coverage secondary to Enterprise s self-insurance. The Court s reasoning here was that Farmers other insurance provision had no application because Enterprise s self-insurance was not insurance.
